    With ChatGPT not meeting COPPA, are schools still using it with students over age 13? I see lots of big names in edtech talking about using ChatGPT in class but I'm not sure how.  Do you just get parents tonsign permission forms to use ChatGPT?

    I want to encourage our teachers to use AI as I believe our students are going to need to understand it in the future, but I don't want the district to violate COPPA.

    Does anyone have any suggestions?

    Hi Holly,

    I thought COPPA only applies to children under the age of 13. Do I have that wrong?

    To more directly answer your question, we're planning to use help students learn to use it honorably and effectively this fall, but will also have their parents sign off that they understand what we're doing.

    Yes, i meant under.

    So with parental permission students can use a site even if it doesn't meet COPPA?
    I think that I am confusing myself

    No worries, Holly.

    The main thing you bring up is that by nature of the work Open AI is doing (free access to generate more data with which to improve their systems), we are face to face with important questions about information privacy. This is another opportunity to use generative AI to help students raise their game with digital awareness and citizenship.

    Holly, it depends on the website and the Terms of Service/Privacy Policy. Some educational tools specify that students under 13 can use a tool with parent permission. Some do not.

    In Open AI's Terms of Service (Chat GPT's parent company) they allow users older than 13 but under 18 with parent permission. I would not let students under 13 use this tool with or without parent permission.

    1. Registration and Access

    You must be at least 13 years old to use the Services. If you are under 18 you must have your parent or legal guardian's permission to use the Services. If you use the Services on behalf of another person or entity, you must have the authority to accept the Terms on their behalf. You must provide accurate and complete information to register for an account. You may not make your access credentials or account available to others outside your organization, and you are responsible for all activities that occur using your credentials.

    So no on under 13 amd 14-18 would need parental permission - is that correct?
    Is it ok for teachers to use as a class under the teacher's account (with just the teacher entering prompts)?

    I want to be ready to our teachers know what they can and cannot do.

    Hi Holly,

    As I understand it, teachers may use the tools at the front of the class (they are the ones logged in and providing prompts) with any grade level. This could be useful in helping students develop a mindset of how these tools can be used productively, and as a vehicle for deeper discussions on how to think about writing. The teacher would of course need to model proper use of the tool (not incorporating any personally identifiable info in the prompts, for example).

    For student use, those 13-18 with parent permission are able to use the tool, from the perspective of Open AI. What is allowed by the teacher/school for use in assignments, and how that is tracked, though, is a function of an agreed-upon approach by teachers and leadership, and articulated in an acceptable use policy for generative AI tools.

    I am not a lawyer, and you should double-check all of this with those at your school/office.

    I am not clear on this. Do we actually know WHY ChatGPT is restricted under age 13? I mean, how does getting parent permission put us in COPPA compliance?

    Parent permission is required for many applications. The age of consent in the US is 13 and older. Under 13, the school/district provides lists of content/sites that teachers will have students access. Parents sign and give permission for accounts to be created. This is even true for your Google accounts. 

    AI sites specifically state 18 and older to consent to create an account, 13 and older with specific parent permission. If your school/district has not updated their policies to include students creating accounts at AI sites then your students cannot use their school accounts to create accounts in AI. 

    Teachers can create AI accounts and may demonstrate how AI works to students, or use AI for their own work. Please be aware that the main reason for not allowing young people to access AI is absolutely PRIVACY. AI sites are specifically designed to not be private. Your searches and results are shared across AI sites, around the world. Children are not capable of providing consent for this sharing of their data. Adults can decide whether they want to or not. You are not allowed to make this decision for your students. Think of it this way. If these were your own children, wouldn't you want the school to ask you before they allowed your child's data to be shared? 

    With AI, proceed with caution! Get your policies and permissions in place before moving forward.

    Or you can actually use the only genrative AI platform that is COPPA certified... GuardRailz!  We are in open Beta and accepting schools/districts for our pilot program.
