As I understand it, teachers may use the tools at the front of the class (they are the ones logged in and providing prompts) with any grade level. This could be useful in helping students develop a mindset of how these tools can be used productively, and as a vehicle for deeper discussions on how to think about writing. The teacher would of course need to model proper use of the tool (not incorporating any personally identifiable info in the prompts, for example).
For student use, those 13-18 with parent permission are able to use the tool, from the perspective of Open AI. What is allowed by the teacher/school for use in assignments, and how that is tracked, though, is a function of an agreed-upon approach by teachers and leadership, and articulated in an acceptable use policy for generative AI tools.
I am not a lawyer, and you should double-check all of this with those at your school/office.

Is it ok for teachers to use as a class under the teacher's account (with just the teacher entering prompts)?

Holly, it depends on the website and the Terms of Service/Privacy Policy. Some educational tools specify that students under 13 can use a tool with parent permission. Some do not.
In Open AI's Terms of Service (Chat GPT's parent company) they allow users older than 13 but under 18 with parent permission. I would not let students under 13 use this tool with or without parent permission.

You must be at least 13 years old to use the Services. If you are under 18 you must have your parent or legal guardian's permission to use the Services. If you use the Services on behalf of another person or entity, you must have the authority to accept the Terms on their behalf. You must provide accurate and complete information to register for an account. You may not make your access credentials or account available to others outside your organization, and you are responsible for all activities that occur using your credentials.

To more directly answer your question, we're planning to use help students learn to use it honorably and effectively this fall, but will also have their parents sign off that they understand what we're doing.

With ChatGPT not meeting COPPA, are schools still using it with students over age 13? I see lots of big names in edtech talking about using ChatGPT in class but I'm not sure how. Do you just get parents tonsign permission forms to use ChatGPT?
I want to encourage our teachers to use AI as I believe our students are going to need to understand it in the future, but I don't want the district to violate COPPA.
Does anyone have any suggestions?
